These Terms & Conditions outline how I work at Mythwood Creative and what you can expect when using my website or working with me on a project. They exist to set clear expectations, protect both you and me, and ensure transparency from the start.
By accessing this website, booking services, or working with me in any capacity, you agree to these Terms & Conditions. If anything here is unclear, please contact me before starting a project. I’m always happy to explain how things work.
These Terms & Conditions may be updated from time to time to reflect changes in how I work or in legal requirements. The most current version will always be available on this page. Continued use of the website or services after updates take effect indicates acceptance of the revised terms.
Mythwood Creative is a sole trader business operated by Marion Hallapera. I provide website design, development, hosting, ongoing website support, and light branding services.
Business address details are provided on this website for legal and transparency purposes. This address is not a correspondence or visitation address. Mythwood Creative operates remotely. For all enquiries, please use the Contact page.
I offer the following services:
Full details of services, pricing and scope are outlined on the Services page and confirmed in writing before any work begins.
All work is carried out within a defined scope agreed in writing between the client and Mythwood Creative. Agreement may be confirmed via email, proposal, invoice, purchase order or other written confirmation.
For institutional or procurement-based clients, purchase orders and written confirmation of work may constitute acceptance of scope and terms, together with these Terms and Conditions.
For individual clients and small businesses, acceptance of a proposal, written confirmation of work, or payment of an invoice constitutes acceptance of the agreed scope and these Terms and Conditions.
For larger or more complex projects, a separate written contract may be used for added clarity and protection.
Any work outside the agreed scope may require additional time and cost. I will always flag this in advance so you can decide how to proceed.
All prices are listed in GBP (£) unless otherwise stated.
Prices are as stated; Mythwood Creative is not currently registered for VAT.
For one-off website projects, a 30% deposit is required before work begins to secure the project. The remaining balance is payable on project completion, prior to launch or handover.
Monthly plans begin once a website project has gone live. Plans are billed monthly, with invoices issued on a recurring basis.
Invoices are issued based on the agreed scope and are payable via bank transfer or other payment methods made available at the time of invoicing.
If payment is overdue, non-essential work or support may be paused until payment is received. Services that include ongoing technical care may continue briefly to avoid disruption, but cannot be maintained indefinitely without payment. I reserve the right to charge interest on late payments.
Monthly plans include ongoing technical care and support as specifically described on the Services page.
Tier 1 (Trailkeeper) focuses strictly on technical foundations, hosting and security. It does not include content updates (e.g., uploading blog posts), design changes, or fixing “user errors.”
Higher Tiers (Wayfinder, Guidepost, Elderpath) include a dedicated monthly support allowance (measured in hours) for hands-on updates.
Minimum commitment:
A minimum commitment of 6 months applies to all monthly plans to allow for proper planning and stability. After this period, plans continue on a rolling monthly basis.
What this means in practice, for instance, if you are on the Trailkeeper plan, I’m looking after the “engine” of your site. If you need me to upload blogs or change your design, that’s not included and will be billed hourly. If you want that help included every month, you’ll need to move up to a tier like Wayfinder which includes dedicated support time.
If additional support is needed beyond what your plan includes, extra work is billed at my standard hourly rate (£60/hour).
I will always check with you before carrying out work that falls outside your plan.
Feedback is built into projects at agreed points, such as structure and design direction. Structured feedback rounds help keep projects focused and avoid unnecessary rework. Timely feedback from you helps keep projects on schedule.
Estimated timelines are discussed at the start of a project and depend on scope, content readiness and feedback turnaround. Delays in providing content, feedback or approvals may impact delivery dates.
For clients on monthly plans, hosting and technical care are managed within my setup, as detailed on the Services page.
For website-only projects without ongoing support, responsibility for hosting, updates, security and maintenance transfers entirely to the client upon handover. Mythwood Creative cannot be held responsible for downtime, security incidents, data loss or other issues arising after handover where ongoing support has not been retained.
As part of the handover, I will provide reasonable guidance on managing and maintaining the site, including updates and basic security considerations. Ongoing responsibility for following this guidance sits with the client unless ongoing support has been agreed.
Once full payment has been received:
Unless we agree otherwise, I usually include a small, discreet design credit in the website footer (e.g., “Designed by Mythwood Creative”) that links back to my website. This credit is included for transparency and professional attribution, and helps support my business by showing real examples of my work. It is kept subtle and does not interfere with your site’s content, branding or user experience.
If you would prefer the credit removed, we can discuss and agree on this as part of the project.
To cancel a monthly plan, please email me with your request.
Should you wish to cancel before the initial 6-month commitment has been met, the remaining balance of the minimum term will become due immediately.
For one-off website projects, a 30% deposit is required before work begins. This secures the project and covers initial planning, setup and design work.
Where possible, I will provide any completed materials or progress made up to that point.
When a service ends, I will provide reasonable support to ensure a smooth handover of the website and related materials.
The scope and format of the handover depend on the services used (for example, ongoing hosting and care versus a website-only project) and will be discussed at the time. This may include access transfer, documentation or a handover call where appropriate.
I work carefully and collaboratively to minimise risk and address issues proactively. I take care to deliver all work to a professional standard, using reasonable skill and care.
However, there are certain things I cannot be held responsible for:
Third-party services:
I am not liable for issues caused by services I don’t own, such as hosting providers, plugins, platforms or external tools. If your site goes down because of a hosting outage or a third-party plugin update, I am not legally responsible for that failure. I am happy to assist in resolving such issues; however, please note that for clients not on a monthly support plan (or for issues outside the scope of the Trailkeeper plan), this work will be billable at my standard hourly rate.
Note: for clients on monthly plans, I always take reasonable measures to actively evaluate and monitor maintenance updates to minimise the risk of an update breaking your site.
Client content & user error:
I am not responsible for the accuracy, legality, or suitability of content provided by you. Additionally, while my monthly plans are designed to be supportive, they do not automatically cover extensive repairs necessitated by “user error” or unauthorised changes to the site’s design and structure.
In plain English: If you (or someone you’ve given access to) accidentally breaks a design element or provides content with copyright issues, the responsibility for that content and the ultimate cost of repair stays with you.
How I handle this in practice: If something small breaks, I’ll always do my best to help you fix it and, more importantly, work with you to ensure you feel confident making those updates safely in the future. However, if a significant “user error” requires extensive investigation or a complete rebuild of a section, that time will be billed at my standard hourly rate.
Indirect or consequential losses:
I am not liable for things such as loss of profits, data, or business interruption, where permitted by law. In plain English, this means, for instance, that if your site is down for an hour and you miss out on a big sale, I am only liable for the cost of the service I provide, not the value of the sale you missed.
Limits of liability:
Nothing in these Terms limits liability where it cannot legally be excluded. My total liability to you for all losses related to our agreement will not exceed the total amount you paid me for services in the 12 months before the claim.
In plain English, this means the cap applies only if a legal dispute arises from a mistake I personally made in my work. It ensures that even in the case of a professional error, the maximum I would be responsible for paying is limited to the total amount you’ve paid me over the previous year. This keeps the business risk proportional to the cost of the project.
Maintenance & handover responsibility:
Proactive monitoring is exclusive to monthly support plans. For “one-off” projects, my responsibility ends at handover. I provide comprehensive documentation on how to keep your site secure; following these instructions is the client’s responsibility. If you manage your own site via the custom backend system I provide, you agree to follow the provided guidance to maintain design consistency. Alterations to these systems as your business evolves are treated as additional project work and billed hourly.
You agree not to misuse this website, attempt unauthorised access, or interfere with its normal operation.
